When making custody decisions, courts must weigh a variety of factors in order to determine what is in the best interest of the child. Courts have generally held that a stable home environment and a fit parent are in a child’s best interest. These factors can become challenging for survivors of domestic violence who flee their homes and enter shelter to secure safety. Some courts penalize survivors by inappropriately applying these factors.
This workshop will address the challenges that battered women, specifically women in shelter, face when seeking custody, and offer strategies to prepare clients for court. The presenters will also highlight why court watching programs are needed to address inequality, injustice and ignorance in the court system. The National Family Court Watch launched its pilot study using a standardized observational instrument in 5 states 4 years ago. The project is designed to gather data that can be used to identify trends, concerns, and effects on families. This presentation we will share some of the data and information our court watchers have collected.

National Family Court Watch Project: Using Research to Drive Policy Change

The National Family Court Watch Project believes that large‐scale data will reveal national trends and ignite a call for change in the family court system. The project is a conversation springboard and a "quiet observer" to get a sense of what's happening in the family courts, report those findings publicly through a new conduit and work with judges and the public to find solutions.
We will be sharing more information about the project and the increasing involvement from professionals and educators as we expand this effort around the country.

This panel presentation will share the real costs involved in appointees added to family law cases. There will be an overview of the various appointees often used in family law cases and what they may be appointed to do. Discussion of the real dollar costs for various evaluations that could occur during the course of a case in California as well as some additional real dollar amounts for other parts of the country. The presentation of an actual proposed 9 page court order written by a court appointee in a real case. Sharing of costs financial, legal and emotional defending entry of such an order.
